Terms of Service

By accessing or using BhojRestro (the “Service”) — including our website at bhojrestro.in, web applications, mobile applications, and APIs — you (“User”, “you”, or “your”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

You must be at least 18 years of age to create an account or use the Service as a Restaurant Owner. End Customers must be of legal age in their jurisdiction to enter into contracts.

The Service is not available to persons who have been banned or suspended by BhojRestro, or to residents of countries subject to applicable trade sanctions.

• You must provide accurate, complete, and current registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us of any unauthorised access to your account at security@bhojrestro.in.
• You may not share your account with others or use another person's account without authorisation.
• We reserve the right to disable accounts that violate these Terms.

BhojRestro provides a cloud-based Software-as-a-Service (SaaS) platform that enables:

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice, except where required by law to provide immediate notice.

You agree not to use the Service to:

7.1 Plans

BhojRestro offers the following plans (pricing subject to change with 30 days' notice):

7.2 Billing

• Subscriptions are billed in advance on a monthly or annual basis.
• All payments are processed securely by Razorpay. We do not store payment card details.
• Prices are in Indian Rupees (INR) and are exclusive of applicable taxes (including GST).
• Failed payments will trigger up to 3 retry attempts; failure to pay may result in Service downgrade.

7.3 Refunds & Cancellations

• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• We offer a 30-day free trial for new accounts — no credit card required.
• Refunds are issued at our discretion for billing errors or documented Service outages exceeding our SLA commitments.
• No refunds are issued for partial subscription periods or unused features.

Our IP: BhojRestro and its licensors own all right, title, and interest in the Service, including all software, designs, trademarks, and documentation. These Terms do not grant you any ownership rights in the Service.

Limited Licence: Subject to your compliance with these Terms and payment of applicable fees, BhojRestro grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes.

Restrictions: You may not copy, modify, reverse-engineer, decompile, or create derivative works from any part of the Service without our prior written consent.

Feedback: Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without obligation of compensation or confidentiality.

Your Content: You retain ownership of all content you upload to the Service (menus, images, order data). By uploading content, you grant BhojRestro a worldwide, royalty-free licence to use, host, and display such content solely to provide the Service.

Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of your content. You represent that you have all necessary rights to share such content.

Data Portability: You may export your data at any time from the Service dashboard. Upon account termination, we will make your data available for download for 30 days before deletion.

The Service integrates with third-party services including Razorpay (payments), Firebase (push notifications), and Google Analytics (analytics). Your use of these third-party services is subject to their respective terms and privacy policies. BhojRestro is not responsible for the practices of any third-party service providers.

BhojRestro does not warrant that the Service will be uninterrupted, error-free, or free of harmful components; that defects will be corrected; or that the Service meets your specific requirements.

Some jurisdictions do not allow disclaimer of implied warranties; in such cases the above disclaimer applies to the maximum extent permitted by law.

BhojRestro's total aggregate liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the fees paid by you to BhojRestro in the 12 months preceding the claim, or (b) ₹5,000.

Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded by applicable law.

You agree to indemnify, defend, and hold harmless BhojRestro and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Service
• Your violation of these Terms or applicable law
• Your Content or your restaurant's operations
• Any third-party claims arising from your use of the Service

By You: You may terminate your account at any time through the Service dashboard or by emailing contact@bhojrestro.in.

By Us: We may suspend or terminate your access with 30 days' notice for any reason, or immediately if you:

• Materially breach these Terms and fail to cure within 14 days of notice
• Engage in fraudulent, illegal, or harmful conduct
• Fail to pay applicable fees after notice

Effect of Termination: Upon termination, your licence to use the Service ceases immediately. Provisions that by their nature survive termination (including Sections 8, 11, 12, 13, and 15) shall continue in full force.

Governing Law: These Terms are governed by the laws of India, without regard to conflict of law principles.

Jurisdiction: The courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction over any dispute arising from these Terms.

Dispute Resolution:

1. Informal Resolution: Contact us at legal@bhojrestro.in. We will attempt to resolve the dispute informally within 30 days.
2. Mediation: If unresolved, either party may request mediation through a mutually agreed mediator in Bengaluru.
3. Arbitration: If mediation fails, disputes shall be finally resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with a sole arbitrator in Bengaluru.

Data Processing Agreement (DPA)

Where BhojRestro processes personal data on your behalf as a data processor (e.g., your customers' order data), we act as your data processor and you act as the data controller. Our processing activities are governed by our Privacy Policy and any applicable DPA executed between the parties.

Your Obligations as a Restaurant Owner (Controller)

• You are responsible for providing adequate privacy notices to your customers regarding data collected through the Service.
• You must have a lawful basis for collecting and processing your customers' personal data.
• You must respond to data subject requests from your customers within applicable timeframes.
• You must not use the Service to process special categories of personal data without explicit consent.

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email to registered users and a prominent notice in the Service. Your continued use after the effective date constitutes acceptance of the revised Terms.

If you do not accept revised Terms, you must stop using the Service before the effective date and may terminate your account without penalty for the remaining subscription period.
