Terms and Conditions

3.1 Account Creation

Restaurant Owners must:

• Provide accurate and complete registration information
• Maintain valid business credentials and licenses
• Keep account information up to date
• Verify email address and phone number

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using strong passwords and enabling security features

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms or applicable laws
• Engage in fraudulent or harmful activities
• Provide false or misleading information
• Remain inactive for extended periods

5.1 Pricing

• Subscription fees are clearly displayed on our pricing page
• Free trial period of 30 days for new restaurant owners
• Prices are subject to change with 30 days' notice
• All prices are in Indian Rupees (INR) unless stated otherwise
• Applicable taxes and GST will be added to subscription fees

5.2 Payment Terms

• Subscriptions are billed monthly or annually in advance
• Payment must be made by credit card, debit card, or approved payment methods
• Automatic renewal unless cancelled before the renewal date
• Failed payments may result in service suspension

5.3 Refund Policy

• No refunds for partial subscription periods
• Refunds may be issued at our discretion for service failures
• Free trial cancellations do not require refunds
• Refund requests must be made within 7 days of charge

6.1 Acceptable Use

You agree to:

• Use the Platform only for lawful purposes
• Provide accurate menu information and pricing
• Fulfill customer orders promptly and accurately
• Maintain food safety and quality standards
• Comply with all applicable health and safety regulations
• Respect intellectual property rights

6.2 Prohibited Activities

You must NOT:

• Upload false, misleading, or deceptive information
• Engage in fraudulent activities or price manipulation
• Attempt to hack, disrupt, or compromise the Platform
• Use automated systems (bots) without authorization
• Violate any laws or regulations
• Harass, abuse, or harm other users
• Share account credentials with unauthorized parties
• Reverse engineer or copy the Platform's code

7.1 Our Rights

All Platform content, including but not limited to:

• Software, code, and technology
• BhojRestro trademarks, logos, and branding
• Design, layout, and user interface
• Documentation and materials

are owned by BhojRestro and protected by intellectual property laws.

7.2 Your Content

You retain ownership of content you upload (menu items, images, descriptions). By uploading content, you grant us:

• A worldwide, non-exclusive license to use, display, and distribute your content
• The right to use your content for marketing and promotional purposes
• Permission to modify content for technical compatibility

You represent that you have all necessary rights to upload your content.

8.1 Order Processing

• Orders are placed directly between customers and restaurants
• Restaurants are responsible for accepting, preparing, and fulfilling orders
• BhojRestro is not responsible for order accuracy or quality
• Order confirmation does not guarantee availability

8.2 Payment Processing

• Payments are processed through secure third-party providers (Razorpay)
• We do not store full payment card details
• Transaction fees may apply
• Refunds are subject to restaurant policies

8.3 Disputes

In case of order disputes:

• Contact the restaurant directly first
• BhojRestro may assist in dispute resolution but is not liable
• Chargebacks may result in account suspension

9.1 No Warranties

We disclaim all warranties, including:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free service
• Accuracy or reliability of content
• Security of data transmission

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the fees paid in the last 12 months
• We are not liable for restaurant actions, food quality, or service issues
• We are not responsible for third-party services or payment processors

11.1 By You

You may terminate your account at any time by:

• Cancelling your subscription through the settings
• Contacting customer support
• No refunds for remaining subscription periods

11.2 By Us

We may terminate or suspend your account immediately if:

• You violate these Terms
• Your account is used for fraudulent activities
• Required by law or court order
• You fail to pay subscription fees
• The Platform is discontinued

11.3 Effect of Termination

Upon termination:

• Access to the Platform will be revoked
• All rights and licenses granted to you will terminate
• You remain liable for any outstanding fees
• We may delete your account data after a reasonable period

15.1 Informal Resolution

Before filing a legal claim, you agree to contact us at legal@bhojrestro.com to attempt to resolve the dispute informally.

15.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in accordance with Indian Arbitration and Conciliation Act, 1996.

15.3 Class Action Waiver

You agree to bring claims only in an individual capacity and not as part of any class or representative action.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BhojRestro.

Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

Waiver

Failure to enforce any right or provision does not constitute a waiver of such right.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms at any time.

The Platform may contain links to third-party websites. We are not responsible for their content or practices.
